Terms of service.

1. Acceptance of Terms

By creating an account, accessing, or using our Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

We reserve the right to update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the updated Terms.

Travel advisors: if you use the Service as a travel advisor, Section 14 and the advisor pages it links to (Client ownership, Support and continuity and the Data processing addendum) govern that use, and where they differ from the rest of these Terms, they take precedence. The personal-use limits in Sections 4 and 5 apply to the consumer tools, not to the work you do for your clients in an advisor workspace. For advisor workspaces, we email you at least 30 days before a material change to these Terms or to those pages takes effect.

2. Eligibility

You must meet the following requirements:

• • Be at least 18 years old
• • Have the legal capacity to enter into binding contracts
• • Provide accurate and complete registration information
• • Not be prohibited from using the Service under applicable laws

By using our Service, you represent and warrant that you meet these eligibility requirements.

3. Account Responsibilities

3.1 Account Security

You are responsible for:

• • Maintaining the confidentiality of your password
• • All activities that occur under your account
• • Notifying us immediately of any unauthorized access

3.2 Accurate Information

You agree to provide true, accurate, and complete information when creating your account. Providing false information may result in account termination.

3.3 One Account Per Person

You may only create one account per person. Creating multiple accounts to circumvent limitations is prohibited.

4. Permitted Use

Our Service is intended for:

• • Personal, non-commercial use for family vacation planning
• • Sharing trip plans with household members or travel companions
• • Accessing planning guides, destination articles, and tools

4.1 AI Assistant Tool (Family Trip Budget)

You may use our Family Trip Budget tool through a supported AI assistant, such as Claude or ChatGPT, to plan your own trips. When you do:

• • Ask about trips you or the people you travel with are actually planning
• • Do not run the tool in bulk or on a schedule to collect our prices, ranges or sources
• • Do not copy, store or combine the results into a dataset, price list, product or service
• • Do not use the results to train or improve an AI model
• • Do not resell the results or present them as your own data

Results are planning estimates, not live quotes, and the tool never books anything. We may limit or block use that breaks these rules. See AI assistants for how the tool works and our Privacy Policy for what it receives.

5. Prohibited Conduct

You agree NOT to:

• • Use the Service for any illegal purpose
• • Harass, abuse, threaten, or harm other users
• • Post spam or unsolicited advertisements
• • Provide false, misleading, or fraudulent information
• • Attempt to gain unauthorized access to our systems
• • Use automated scripts, bots, or scrapers (using the AI Assistant Tool as described in section 4.1 is allowed)
• • Reverse engineer or decompile any part of the Service
• • Resell or redistribute access to the Service
• • Interfere with the proper functioning of the Service

Violation may result in immediate account termination and legal action.

6. Intellectual Property

6.1 Our Ownership

We own all rights to:

• • The Service platform, including software, design, and features
• • Planning tools (Budget Calculator, Family Vote, Visual Itinerary Builder, Smart Packing List)
• • Planning guides and destination articles
• • Branding, logos, and trademarks

6.2 Your Ownership

You retain ownership of:

• • Trip planning data you create (budgets, itineraries, packing lists)
• • User-generated content (comments, feedback)

By using our Service, you grant us a limited license to store, process, and display your trip data as necessary to provide the Service.

7. Pro Subscriptions (Annual Pro and Trip Pass)

7.1 Subscription Terms

• • Annual Pro: $24.99/year, renews automatically
• • Trip Pass: $4.99 one-time, grants Pro access for 60 days, does not renew
• • Free Trial: 14-day free trial with new Annual Pro subscriptions

7.2 Automatic Renewal

Annual Pro renews automatically unless you cancel before the renewal date. Trip Pass is a one-time purchase and never renews.

7.3 Refund Policy

• • Trip Pass: A one-time purchase that never renews, so there is nothing to cancel. Full refund if you ask within 3 days of purchase; no refund after that.
• • Annual: Full refund if you ask within 14 days of purchase. After that no refund is issued: cancelling stops the next renewal and you keep access until the end of the paid year.
• • How to ask: e-mail support@endlesstravelplans.com from the account's e-mail address within the window. The window is counted from the date Stripe charged you, not from when you first used the product.
• • Free Trials: Cancel during trial to avoid charges.

8. Affiliate Disclosures

Our Service contains affiliate links to third-party products and services:

• • Amazon Associates: Commissions from qualifying purchases
• • Travel Booking Partners: Commissions from flights, hotels, car rentals

You pay the same price whether you use our affiliate links or not.

9. Travel Disclaimers (IMPORTANT!)

9.1 Planning Tools Only

We provide planning tools, NOT travel booking services. We are not a travel agency, tour operator, or booking platform.

9.2 No Liability for Travel Disruptions

We are not responsible for:

• • Flight cancellations, delays, or schedule changes
• • Hotel overbookings, closures, or quality issues
• • Lost luggage, travel restrictions, or visa denials
• • Natural disasters, weather, or force majeure events
• • Health emergencies, accidents, or theft

9.3 Your Responsibility

• • Verify all travel requirements (passports, visas, vaccinations)
• • Check official government travel advisories
• • Confirm booking details directly with providers
• • Purchase appropriate travel insurance

10. Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

We do not guarantee that:

• • The Service will be error-free or uninterrupted
• • Information provided is complete or up-to-date

Our total liability shall not exceed the amount you paid us in the 12 months prior to the claim (or $100 if you have not paid anything).

11. Indemnification

You agree to indemnify and hold harmless Endless Travel Plans LLC from any claims arising from:

• • Your use or misuse of the Service
• • Your violation of these Terms
• • Your violation of any third-party rights
• • Your travel bookings or travel activities

12. Dispute Resolution

12.1 Informal Resolution

Before filing a legal claim, contact us at support@endlesstravelplans.com.

12.2 Binding Arbitration

If informal resolution fails, disputes shall be resolved through binding arbitration:

• • Rules: JAMS Streamlined Arbitration Rules
• • Location: Sheridan, Wyoming or remote

12.3 No Class Actions

Disputes will be resolved on an individual basis only, not as a class action.

12.4 Governing Law

These Terms are governed by the laws of the State of Wyoming, USA.

13. Termination

13.1 Termination by You

You may delete your account at any time from your account settings. Deletion is permanent.

13.2 Termination by Us

We may terminate your account if you:

• • Violate these Terms
• • Engage in prohibited conduct
• • Fail to pay subscription fees
• • Pose a security or legal risk

13.3 Effect of Termination

• • Access to the Service will be revoked
• • Trip data deleted within 30 days
• • An advisor workspace is erased at once when you close the account. Invoices and payout records are kept for as long as tax law requires. On a kept invoice the client's name is replaced and their email, phone and notes are removed; the billing address printed on the invoice stays, as part of the tax record. Backups age out within 90 days.
• • Prepaid fees are non-refundable (except as stated in Section 7)

14. Advisor Pro (Travel Advisors)

Advisor Pro is a separate workspace for professional travel advisors and is not part of the family plans in Section 7. An advisor account starts on a free tier; the paid seat is $19 a month or $180 a year, billed through Stripe.

• • Renewal: a seat renews monthly or yearly until you cancel. Cancelling stops the next renewal; access continues to the end of the period already paid.
• • Charges you did not intend: e-mail support@endlesstravelplans.com from the account's e-mail address; the refund windows in Section 7.3 are written for family plans and do not apply automatically to a seat.
• • Your clients stay yours: client records, itineraries and documents an advisor creates belong to the advisor, as set out in Client ownership.
• • Support and continuity: response times, export and what happens if the Service closes are in Support and continuity.
• • Client personal data: we process it on the advisor's instructions under the Data processing addendum.
• • Professional responsibility: the advisor, not Endless Travel Plans, is the seller of any travel the advisor books for a client. Section 9 applies to every estimate and suggestion the tools produce.

15. Partner Programme (Referrals)

Advisors and approved partners may refer families with a personal link. The programme terms below are the published standard; an account may carry different terms in writing, in which case those govern.

• • Commission: 30% of what a referred family pays for Annual Pro, for 12 months from their first payment, and a flat $2.00 for each Trip Pass. The rate is applied to the amount Stripe actually settles, after discounts. A purchase made inside our iOS or Android app earns the same commission on the price the app store charged, less the store's fee of 15%; the Trip Pass bounty is the same flat amount either way.
• • Attribution: the referral link sets a cookie for 60 days; the last partner link opened before sign-up is credited. In the app, a family may instead type a partner code when they create their account; the code must be entered at sign-up and cannot be added later. Self-referrals and referrals of an existing account do not earn commission.
• • Clearance: a referral reward clears 30 days after the payment that earned it, once the customer's refund window has passed. A refunded or charged-back payment reverses the referral reward it earned. If a payment is refunded after its referral reward was paid out, that amount is deducted from your future earnings.
• • Payout: cleared referral rewards are paid monthly through Stripe Connect once the balance reaches $10. Smaller balances roll into the next period. Tax forms required before a payout are described in Tax forms.
• • Conduct: no paid search on our brand terms, no spam, no misleading claims about the Service, and no coupon or cash-back sites. We may withhold commission earned in breach of these rules and close the partner account under Section 13.
• • Changes: we may change the published programme terms with notice by e-mail; commissions already earned keep the terms in force when they were earned.

16. Miscellaneous

These Terms, together with our Privacy Policy and, for advisor workspaces, the advisor pages listed in Section 14, constitute the entire agreement. If any provision is found invalid, the remaining provisions remain in effect.
